Product availability

Risk, delivery and checking the goods
The goods are shipped in the manner agreed when the order is placed. Unless otherwise stated, shipment is by standard delivery, with any charges shown to the customer at the time of purchase.
The risk relating to the carriage of the goods passes to the customer upon delivery to the carrier, within the limits laid down by the legislation in force.
On delivery, the customer is required to check carefully that the parcels are intact and that the quantity and quality of the goods match what is stated in the transport documents.
Any evident discrepancies must be reported immediately on delivery, by noting them on the transport document and notifying customer service within the time limits laid down by the applicable legislation.
Any defects that cannot be detected immediately must be reported within the statutory time limits from the discovery of the defect, in the manner set out in the “Returns and Warranty” section.
Any dispute concerning the interpretation, performance and validity of these terms shall fall within the jurisdiction of the consumer’s court, within the limits laid down by mandatory legislation.
The customer declares that they accept responsibility for the information provided when placing the order and that they have checked that it is correct.
Right of withdrawal
The consumer is protected by Articles 52 et seq. of D.Lgs. 206/2005 (Codice del Consumo, the Italian Consumer Code), which provide for the possibility of withdrawing from the contract and returning goods purchased online within 14 days of the date of receipt of the goods, without having to give any reason.
The right of withdrawal may be exercised in the manner set out in the dedicated “Returns, Exchanges and Withdrawal” section of the website.
The cost of returning the goods is borne by the customer, unless otherwise expressly provided for by the legislation in force or by specific commercial promotions.
Orders
Orders may be placed only through the website (online) or, where available, by telephone with customer service.
At the end of the online purchase process, the customer will receive an automatic confirmation by e-mail containing a summary of the order and its identification number.
Receipt of the order confirmation does not automatically constitute final acceptance of the purchase offer, which is deemed to be concluded only once product availability and the actual possibility of fulfilling the order have been verified.
If, for technical or administrative reasons or because products are unavailable, the order number is not generated or confirmed, the purchase offer shall be deemed not accepted and not binding on pescaloccasione.biz, and the order will consequently be cancelled without any further obligations.
Prices

Payment is considered complete only when the amount has actually been credited to the seller’s account or confirmed by the payment network used.
Packaging
Product packaging is included in the delivery charge and is carried out with materials appropriate for protecting the goods and keeping them intact in transit.
Standard, strong and secure packaging is used for terminal tackle, accessories and fishing rods, suitable for minimising the risk of damage during shipment.
Special packaging for fishing rods
At the customer’s request, a packaging service using a rigid PVC tube is available for fishing rods.
- The cost of the service is €15.00 per rod.
- The service must be requested by the customer by e-mail immediately after purchasing and paying for the order.
- The amount for the packaging will be communicated and agreed before dispatch.
- The surcharge will be paid using the same payment method as the order, subject to any different conditions or limitations of the payment system used.
The reinforced packaging service is optional and recommended for greater protection in transit.
Delivery
Orders are handed over to the express courier within the times shown on the product page and subsequently confirmed in the order confirmation e-mail.
At the time of dispatch, the customer will receive an e-mail notifying them that the order has been shipped. The courier will then send a message with the tracking number so that the delivery can be followed.
The delivery times shown are estimates only and are not binding, as they may vary depending on the destination and courier operations.
Returns conditions
In the event of a return, the goods must be sent back intact, unused and complete with the original packaging, accessories and labels, where present.
The customer is liable for the diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning. In such cases, the refund may be reduced in proportion to the product’s loss of value.
Payment in instalments (Scalapay)
When paying with Scalapay, the customer receives the product immediately and pays the amount in three instalments.
The customer acknowledges that the receivable arising from the payment will be assigned to Incremento SPV S.r.l., to related parties and to their respective assignees, and hereby authorises such assignment, in accordance with the terms and conditions of the Scalapay service.
